I currently have mental capacity

You must have mental capacity (the ability to make your own decisions) when you create your LPA. An LPA cannot be made after you have lost capacity.

I am 18 years of age or over

You must be at least 18 years old to make a Lasting Power of Attorney.

I am resident in England or Wales

This LPA service is for residents of England and Wales only. If you live in Scotland, you need a Power of Attorney under Scots law. If you live in Northern Ireland, you need a different form of power of attorney.

I understand what an LPA is and am making this decision freely

No one should be pressuring you to make an LPA. You should understand that you are giving your attorney(s) the legal authority to make decisions on your behalf.

How Should Your Attorneys Act?

When you have more than one attorney, you must decide how they make decisions together.

Jointly

All attorneys must agree and sign together on every decision. More secure but less flexible — if one attorney can no longer act, the LPA may stop working.

Jointly and Severally

Attorneys can make decisions together or independently. Most flexible and most commonly chosen option.

Jointly for some, Jointly and Severally for others

Some decisions require all attorneys to agree, others can be made independently. You can specify which decisions require joint agreement in the instructions.

Register with the OPG

Send your signed LPA to the Office of the Public Guardian for registration. The OPG fee is £92 per LPA. Registration takes approximately 20 weeks.
